Please read the following terms and conditions which relate purchase of a subscription to our website. By purchasing a subscription you are agreeing to these terms and conditions.

1. Access

1.1 General

This website is designed for members of the public and patients and doctors to work together.

Patients: BMJ BestTreatments does not offer medical advice and should not be seen as a replacement for a consultation with a doctor or other health professional. The articles and information on this site are designed to help you talk to your doctor, not to be used instead of seeing your doctor.

For doctors: The information on BMJ BestTreatments is not designed to take the place of your own clinical experience and judgement. We aim to equip you with clinical evidence to help you choose the best treatments for your patients. We supply the evidence; you and your patient make the decisions.

2. Our Products

Descriptions of what is included in each subscription for BMJ BestTreatments is contained on our Buying BMJ BestTreatments page.

The BMJ Publishing Group Limited (“BMJ Group”) reserves the right to have full editorial control over BMJ BestTreatments and may make changes to the website during the subscription period.

3. Placing an Order and Our Acceptance

3.1 When making a request to do an online payment, the language that will be offered to you for conclusion of this process, will be in English only.

3.2 When submitting your request to purchase any BMJ BestTreatments subscription, you will be asked to indicate which products you wish to subscribe and then further information on the registration page. You will then proceed to an alternative screen, which will set out the cost of the subscription including taxes where applicable. You will then be requested to confirm you accept our terms and conditions and privacy policy. You will then proceed to our payment section and submit details via a secure payment system and when you do submit it, you are making an offer to purchase a personal subscription to BMJ BestTreatments which we may accept or decline. After you submit your offer, you will receive confirmation that your payment was either successful or unsuccessful.

3.3 We may at that time allow you to have temporary access online to the BMJ BestTreatments, but this is a gesture of goodwill and does not represent acceptance of your offer. Access will need to be made via the username and password, you supplied upon registration. Irrespective of payment, for annual subscriptions and 30 days passes our contract will not become binding until 5 working days has elapsed from which a successful payment is made and only if we do not contact you. This is in case any price errors have occurred and if so we will contact you. If accepted, delivery will take place as set out under Clause 6.

3.4 Please note, if you wish to cancel any subscription you purchase after our contract comes into effect cancellation shall be at our discretion, and if accepted may be subject to a cancellation charge. As you are ordering an online “periodical”, there is no right of cancellation as a consumer, unless this is faulty or as otherwise required by law.

3.5 BMJ BestTreatments is supplied subject remaining in current circulation. In the event that we are unable to continue to supply BMJ BestTreatments for the agreed term, we will inform you as soon as possible and provide you with a pro rata refund in the event that you have paid for a period for which we cannot comply. We will not however be liable for any direct or indirect loss caused as a result of not being able to supply you with the subscriptions for all or any of the periods subscribed to.

4. Your Account Details

If your order is accepted, you will be responsible for maintaining confidentiality of your online access and username and password and restricting access to your computer or preventing unauthorised access to your account. You agree to take responsibility for all activities that occur under your username and password. If you believe that your username and password is being used by anyone else you should inform us immediately, as well as if it is likely to be used in an unauthorised manner.

5. Prices and Payments

5.1 The price that you pay for the BMJ BestTreatments subscription you order should be the standard pricing as indicated on the website plus taxes which will be calculated depending on your location. Prices indicated are valid for purchases during the calendar year which they relate to. For subscribers who are located in the United Kingdom and everywhere else other than the USA, you will be required to make payment in Pounds Sterling. The exchange rate will be calculated by your bank. US based customers will be required to pay in US dollars.

5.2 Whilst we try to ensure that all of our prices on our website are accurate, errors may occur. If we discover any error in the prices of the products you have ordered, we will inform you as soon as possible and give you the option of recommencing your order at the correct price or cancelling it. If you do not respond to our contact, we will treat the order as cancelled. If you cancel and we have already processed your payment, you will receive a full refund.

5.3 Payments may be made through the method specified on our payment options section prior to concluding the transaction. We take all reasonable precautions to keep the details of your order and payments secure, unless where negligent we cannot be held liable for losses caused as a result of unauthorised access to the information provided by you.

6. Delivery

6.1 We will make every effort to deliver the goods within the estimated timescales, however delays are occasionally inevitable and time of delivery will not be of the essence.

6.2 Once you have made your payment you should be able to access BMJ BestTreatments, by using your username and password, and delivery will have deemed to have taken place (subject to acceptance of your offer).

7. Intellectual property rights

The content, layout, design, data, and graphics on this website are protected by UK and other international copyright laws. You agree not to adapt, alter or create any derivative work from any of the material contained in the website or to use the material for any purpose other than your personal, non-commercial use. None of the content of this website may be copied or otherwise incorporated into or saved in any other website, electronic retrieval system, publication, or any other work in any form (whether hard copy, electronic, or other), For the avoidance of doubt, framing of this site or any part of it is not permitted without our express written permission.

The BMJ Group trademarks and logos which are displayed on this Website are the trademarks of the BMJ. Any use of BMJ Group trademarks or other trademarks displayed on this Website is strictly prohibited without our expressed written consent.

Use of the data you provide to us or which is collected by use of this website, is governed by our Privacy Policy.

11. Links

This website contains links including hyperlinks which may take you outside this website. Links are provided for your convenience, and inclusion of any link does not imply endorsement or approval by us of the linked website (other than where this is another BMJ website which is subject to our terms and conditions), its operator or its contents, and we are not responsible for the content of any website outside of BMJ websites.

12. Losses

We will not be liable for any direct or indirect or consequential losses (including loss of profit, revenue, anticipated savings, data, goodwill or wasted expenditure) other than when your subscription cannot be fulfilled, following conclusion of a binding contract and in which case the BMJ Group shall be liable only for the fees paid for the subscription. We do not however exclude or limit our liability for death or personal injury caused from our negligence or misrepresentation or any other liability that may not be excluded by law.

Use of BMJ BestTreatments content is subject at all times to all Conditions of use and disclaimers as contained on the BMJ BestTreatments website which BMJ Group may amend from time to time. You should regularly review these when you access BMJ BestTreatments.

13. Events Beyond Our Reasonable Control

To the fullest extent permitted by law we will not be held responsible for any delay or failure to comply with our obligations under these conditions if such delay or failure arises from any causes which is beyond our reasonable control including reasons of Force Majeure which shall include any default due to an act of God, war, threatened war, act of terrorism or threatened terrorism, lock out, individual action, fire, flood, drought, tempest or other event beyond our reasonable control. This provision does not affect your statutory rights.

14. Alternation of Service or Amendments to Conditions

We reserve the right to make changes to our website, policies and terms and conditions at any time. You shall be subject to the policy's terms and conditions in force at the time that you use the website. If any of these conditions are deemed invalid, void or unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any other condition.
